Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Collab Dock ("Collab Dock", "we", "us"). By accessing or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.
1. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract. Creator accounts are subject to manual review and may be approved, rejected, or removed at our sole discretion. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
2. The Marketplace
Collab Dock provides a marketplace through which brands ("Brands") may discover approved creators ("Creators") and enter into paid collaboration agreements ("Campaigns"). Collab Dock is not a party to Campaigns and does not produce, endorse, or guarantee any creator content. The contractual relationship for any Campaign is between the Brand and the Creator.
3. Campaign Workflow
Campaigns move through defined stages: invite, negotiate, agree, deliver, approve, payout. Funds for Campaigns are held in escrow by our payment partner and released according to the Campaign milestones and our Refund Policy.
4. Fees
Collab Dock charges a platform fee on each Campaign, disclosed at the time the Campaign is funded. Payment processor fees may apply separately. Fees are non-refundable except as described in our Refund Policy.
5. Content and Licenses
Creators retain ownership of content they create. By submitting deliverables through a Campaign, the Creator grants the Brand the license specified in the Campaign brief. By using the Platform, you grant Collab Dock a limited license to host, display, and transmit your content solely to operate the Platform.
6. Acceptable Use
You agree not to: misrepresent your identity or metrics; purchase or inflate followers, views, or engagement; post unlawful, infringing, defamatory, or harassing content; circumvent the Platform's payment or messaging systems; attempt to reverse engineer or scrape the Platform; or use the Platform in violation of applicable laws, including advertising disclosure laws (such as FTC Endorsement Guides, ASA CAP Code, and local equivalents).
7. Third-Party Platforms
Some features integrate with third-party platforms such as TikTok, Instagram, and YouTube. Your use of those platforms is governed by their own terms, including the TikTok Terms of Service and TikTok Developer Terms of Service. You are responsible for complying with each platform's policies, including branded content and disclosure rules.
7a. TikTok Integration and Verification
Collab Dock uses TikTok Login Kit to authenticate creators. Our domain verification file is available at: https://collabdock.lovable.app/tiktokSt4VsZ8gsjexEfQbHXWFSOLTfgAVq70X.txt.
8. Suspension and Termination
We may suspend, restrict, or terminate any account at any time for breach of these Terms, suspected fraud, or risk to the Platform. You may close your account at any time; obligations that by their nature should survive termination will survive.
9. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COLLAB DOCK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO COLLAB DOCK IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
11. Indemnity
You agree to indemnify and hold Collab Dock harmless from any claims arising out of your content, your Campaigns, or your breach of these Terms or law.
12. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, without regard to conflicts principles. Disputes will be resolved by the courts of London, England, except that consumers may have the right to bring proceedings in their country of residence. Where required by local law, mandatory consumer protection rights of your country of residence apply.
13. Changes
We may update these Terms. Material changes will be notified at least 14 days before they take effect; continued use after the effective date constitutes acceptance.
